

Elusive Production agrees upon the following terms and conditions;

1.1 The charge is payable in full 7 days before the booking. The Company will issue a receipt and detailed confirmation of the booking upon request; otherwise an email confirmation will be issued. The customer is responsible for checking the details contained in the confirmation and for bringing any errors to the immediate attention of the company.

1.2 Subject to clause 2 below, the charge is strictly non-refundable except in circumstances where the Company, due to causes beyond its control, cancels or, at its absolute discretion, agrees to cancel the booking.

1.3 A deposit must be paid agreeable with the Company and customer, at the time of booking, unless it is within 7 days of the booking date, in this situation full payment will be required immediately and will be non- refundable subject to
​
2. In the event of a cancellation by the customer, cancellation charges shall be as follows: –

2.1 Cancellation after booking – DEPOSIT is strictly non-refundable as work will have been carried out from the moment you book with us to prepare for your booking and hold your date.​​

2.2 Cancellation within 7 days of hire – non-refundable but the Company, at its absolute discretion, may permit all or part of such monies as shall have been paid to it by the customer in respect of the cancelled period of the booking to be applied to a future booking from the company.

2.3 If the customer does not appear at the time and place designated as the pickup point, all monies paid will be non-refundable.

2.4 If the customer (booker) has issues with the service on the day, this should be bought to the companies attention immediately. Failure to do so immediately and acceptance of the booking and usage of the equipment on the booking day, will mean you are happy to proceed with the service. All outstanding balance and monies will be payable, and no refunds will be made.

3. Force Majeure – The Company will use reasonable means to ensure that the staff arrives on time to begin the service on time. The Company will not incur any liability or refunds of whatsoever in the event of any delay due to causes or circumstances beyond its control and a service is late or cannot be provided at all. Instances of this include Road closures, Road Accidents, Police Incidents, Weather conditions, Administrative Errors, Vehicle Breakdowns, Government acts, Lockdowns, Terrorism, War, Disease… this list is not exhaustive.​

4. The Company reserves the right (and delegates to its staff the right) to refuse service to any person who is thought to be under the influence of excessive alcohol or drugs and/or whose behaviour is considered to pose a threat to the staff. The Company will not tolerate any verbal or physical abuse directed to its staff or other clients and will pursue the authorities for prosecution if necessary.

5. If the customer (booker) damages staff equipment on the day of the booking this will reported as criminal damage and all deposits and payments will be lost and booking cancelled.​​

6. When entering a booking contract with a client, we will set clear start/end times and grace periods for the production setting, any client intervention to pervert these set times will end in either booking delays or cancellation.

7. Photos/Videos taken by Elusive Productions are still owned after booking has concluded, this means we may use such photos for marketing purposes and or website client photos, if the client would otherwise not want this to be public on our socials/website then please mention this once the booking has ended and we will honour your privacy, if you do not mention this we will assume the latter.

8. Protection clause - bookings that involve such a high bar and require immense attention to detail such as weddings / baby showers or one in a life time events, will be strain our employees to function at the best of their ability to ensure your special day is as perfect as possible, unfortunately not everyone will see it this way and will criticize and or publicly bash the company based on how they feel the photos / videos should have come out, not everything can be perfect and sometimes things can go wrong, this clause is to protect us from any unwanted backlash to if photos/videos and or any of media are not up to your personal liking, we are NOT responsible for this and once the booking is done and media is sent off we will attempt to accommodate any edits or modifications you request but we are not under any obligation to do so nor any refund being required.

9. Night-time / late evening shoots, due to the elements sometimes any photos/videos taken after hours during the dark will be difficult to shoot/record, we will try our best with the equipment at hand (flashes/lights boxes/lightbars etc) but as not all events are the same and some have a darker environment and or darker lightning, as a result of this it may become difficult if not impossible to shoot without any artifacts showing in photos/videos taken, this clause is also to protect us from any backlash for using bright lights during these difficult conditions to try get useable media.

​10. Nothing contained in these terms and conditions affect the Client’s’ statutory rights.
GDPR & Privacy
Elusive Production uses your data to send you emails with quote and information on its services. By accepting to continue to browse the website and by entering your personal details, you give Elusive Production permission to contact you via the phone, SMS or Email as necessary.

Elusive Occasions keeps all data for as long as it is necessary if you have booked with us, then it is deleted. If no booking was originally made, we usually delete your data within 3 weeks.
